Terms of Use

By downloading, installing, or using StokX(the "App"), you agree to be bound by (a) Apple's Standard End User License Agreement and (b) these supplemental Terms of Use. If you do not agree, do not download or use the App.

Be Shiftgrants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on any Apple-branded device that you own or control, solely for personal, non-commercial purposes and subject to the Usage Rules set forth in Apple's App Store Terms of Service.

• The App offers optional auto-renewing subscriptions ("Pro Monthly" and "Pro Yearly") managed entirely by Apple through the App Store.
• Payment is charged to your Apple ID at confirmation of purchase.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel subscriptions at any time via Settings > [your name] > Subscriptions on your iPhone or iPad.
• No refunds are given for partial subscription periods, except where required by applicable law. For refund requests, please use reportaproblem.apple.com.
• A free trial period, if offered, will be specified at the time of purchase. Any unused portion of the free trial will be forfeited upon purchasing a subscription.

You retain all intellectual property rights in original artwork and images you create or upload through the App ("User Content"). By using the App you confirm that:

• You own or have the necessary rights to all User Content you use in the App.
• Your User Content does not infringe the intellectual property, privacy, or other rights of any third party.
• You will not use the App to reproduce copyrighted material without authorization.

All App content, design, code, AI models, and trade dress are owned by or licensed to Be Shift and are protected by applicable intellectual property laws.

You agree not to:

• Reverse-engineer, decompile, or disassemble the App.
• Use the App to create content that is unlawful, infringing, defamatory, obscene, or harmful.
• Attempt to gain unauthorized access to any portion of the App or related systems.
• Distribute, sublicense, or commercially exploit the App without prior written consent from Be Shift.
• Use automated means to access or scrape App features.

Be Shift is solely responsible for providing maintenance and support services for the App. Apple has no obligation to furnish any maintenance or support services with respect to the App.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BE SHIFT DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BE SHIFT AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR USE OF (OR INABILITY TO USE) THE APP.

Be Shift is solely responsible, not Apple, for addressing any claims by you or a third party relating to the App or your possession and use of the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to applicable legal or regulatory requirements; and (iii) claims arising under consumer protection, privacy, or similar legislation.

In the event of any third-party claim that the App or your possession and use of the App infringes that party's intellectual property rights, Be Shift, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.

These Terms are governed by the laws of the jurisdiction in which Be Shift is established, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of that jurisdiction.

We may update these Terms at any time. Changes take effect when posted to this page with a revised Effective Date. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
